How a Foreclosure Case Runs at Rai Law

You should know what you are buying before you buy it. This is what happens, in order.

1. The case review, before you pay anything:

We talk, and then we look. We pull the court docket and read what has actually been filed and entered, and we look at what is recorded against the property. Then we tell you where the case really stands, which options are open, and what we would do first. If we do not think you need us, we will tell you that too.

2. Retainer and opening the matter:

If you decide to go ahead, you get a written retainer agreement that states the scope and the fee, sent for electronic signature. Nothing starts on a handshake. Once it is signed, the matter is opened in our case management system and you are told who to contact about what.

3. Two tracks, running at the same time:

The court defense and the loss-mitigation application do not take turns. The litigation track answers the complaint, raises defenses and handles discovery and motions; the loss-mitigation track prepares the application, submits it and manages the servicer. They talk to each other constantly, because each one changes what the other should do - a pending application changes the argument for holding a sale, and a court deadline changes what the servicer has to be told, and when.

4. Every deadline is calendared the day it is created:

Court orders, motion dates, response deadlines, servicer decision deadlines, appeal windows. Foreclosure cases are lost on dates far more often than on arguments, and servicer deadlines are the dangerous ones because no court sends a reminder when one lapses.

5. You hear from us on a schedule, not only when something is wrong:

You get told what happened at a court date, what was submitted, what we are waiting on, and what the next date is. If you have not heard from us and want to know where things stand, call - that is not an imposition, it is the service.

6. Resolution, and closing the file properly:

Whether it ends in a modification, a dismissal, a settlement or a sale, the file gets closed out on paper: the servicer is notified, the court file is squared away, the accounting is finished, and you get your documents. You should not have to wonder whether something was left undone.
